Brokers who have pay support staff (W2 or 1099) in New York City, unless they are incorporated as “C”corporation, are subject to UBT which is 4% of gross commissions (e.g., $4,000 tax for every $100,000 of commission income). Even if you have an LLC or “S” corp you are subject to UBT. You can avoid UBT by working with an employer of record (EOR) to pay your people so they are not your employees. As NYC looks to increase tax revenue, more and more agents are being audited to determine if UBT is owed.
